Life Insurance Claims

Life insurance is meant to provide a lump sum monetary payment to help with any and all expenses needed during the difficult time of losing a loved one. However, once a claim is presented after a death, an insurance company may decide to conduct an investigation to determine if there has been any misrepresentation in the initial application. If the insurance company is of the opinion that a certain medical condition has not been disclosed or that there has been any other fact misstated on the application, the insurance benefits may be denied.

Oldfield vs. Transamerica Insurance Company

When Mrs. Oldfield’s husband died suddenly after a criminal act, the insurance company refused to pay her the proceeds of his policy. They claimed that the policy was in default because it did not cover death by a criminal act. Alfred Kwinter took the case to the Supreme Court of Canada, which ruled that public policy should not bar the rights of an innocent beneficiary to obtain proceeds of a life insurance policy, regardless of the activities associated with the insured’s death. This was a groundbreaking decision and made front page news across the country.
