Hit by a drunk driver? Here’s what you do.
A Serious Accident
Drunk drivers cause some of the most serious accidents. They have impaired vision, impaired reaction time and uncontrolled speed, causing head-on collisions, rear-end collisions and/or pedestrian accidents.
Call 911
First thing to do if you have been hit by a drunk driver is to call 911. You will need to report the incident to the police and seek immediate medical help on site. If, in the unfortunate event the drunk driver has sped off, make sure you try to gather as many details of the car as possible, including the make, model, and license plate number. It would help if you took pictures of the accident site, speak to witnesses, and get contact details of the witnesses. Every little detail will be important. Remember motor vehicle accidents involving drunk drivers will have a criminal component to the case and the police will require these details to charge the drunk driver.
Lawsuit for Damages
In a separate action, you may also be able to file a civil lawsuit for damages, to get compensated for losses from the accident, including lost wages, pain and suffering, future care. You will also be entitled to receive no-fault accident benefits.
If injuries are serious then prompt medical attention, treatment, follow-up, and rest are crucial to recovering from and/or coping with the injuries. Having the right treatment team behind you and access to funds for medical assistance you need will greatly benefit the recovery process. An accident benefits claim that you commence will aid with immediate funding requirements for treatment, income replacement, support for personal care assistance, amongst others.
Inevitably family members suffer with the victims, both emotionally and financially. If family members of victims who have suffered serious injuries or have died from an accident require psychological treatment, income support etc., accident benefits may be available to them. Additionally, they may also be able to seek remedy in the civil lawsuit through Family Law Act claims.
