GETTING LEGAL: Ontario Cyclists Affected by Changes to the Highway Traffic Act

Ontario recently passed a number of changes to the Highway Traffic Act through Bill 31, Transportation Statute Law Amendment Act (Making Ontario’s Roads Safer), 2015. Cyclists will be affected by these changes including the provisions which: Require drivers to maintain a minimum distance of one-metre when passing cyclists Increase fines for “dooring” cyclists Allow cyclists to use the paved shoulders of non-400 series highways Allow the use of flashing red lights on the rear of bicycles Allow bike lanes on one-way streets to run in the opposite direction from regular [...]

Court of Appeal duty to defend decision

There are two new Court of Appeal decisions that could have significant consequences. Unfortunately, it appears that the Court either was not directed to the potential interpretations or decided to ignore them. In any event, there is, in my mind, a significant problem.
