Fire Loss Claim

In July 2003, following a seven and a half week trial involving a fire loss/arson claim, a St. Catharines’ jury awarded Alfred Kwinter’s client, Frank Mazza, the amount of his claim plus $2,000,000 for punitive damages.

In addition his tenant, Adelia Perreira was awarded the amount of her claim plus $500,000 for punitive damages – a new Canadian record. Frank had purchased a farm and hoped to grow mushrooms. The farm burned down before he could harvest a crop. The insurance company claimed Frank had torched the farm for the insurance proceeds. The jury rejected this defence and awarded Frank and Adelia $2,500,000.
